Between Demolition and Protection The Unmaintained Building in Québec Municipal Law

Abstract
The issue of demolition by neglect affects many cities around the world. It occurs when a heritage building is left unmaintained for several years until destruction becomes inevitable. Municipal law is closely connected to this problem since it allows cities to adopt by-laws meant to regulate maintenance and prevent the demolition of heritage buildings. The study of demolition by neglect raises questions about the powers that cities may exercise to prevent this phenomenon. The purpose of this paper is to shed light – from a legal and international perspective – on the problem of demolition by neglect by taking the example of Quebec civil law. Recently faced with a wave of demolition of heritage buildings, Quebec’s legislator chose to adopt, in April 2021, a bill intended to confer powers and obligations on cities to ensure the maintenance of heritage buildings. The analysis of this bill and the legal causes that led to its adoption is an opportunity to investigate the foundations of both Quebec municipal law and the powers to prevent demolition by neglect.
